General Terms and Conditions of Discounted Safaris

Introduction and Scope of Services

Discounted Safaris GmbH, based in Barcelona, Spain (hereinafter referred to as «Discounted Safaris»), operates the website www.discountedsafaris.travel, which includes its social media channels and mobile applications, collectively referred to as the «Platform.» Through this Platform, tour operators («Operators») can promote, market, and sell package tours in compliance with Directive (EU) 2015/2302 to registered users («Travelers» or «you»).

Beyond searching and booking tours, Travelers can use the Platform to compare operators, read reviews, participate in contests, and explore various travel-related functionalities (collectively referred to as the «Discounted Safaris Services»).

Applicability of Terms and Conditions

These terms and conditions govern all aspects of the Services offered by Discounted Safaris and outline the rights and obligations of Travelers when using the Platform. Depending on your location, the following versions of the terms and conditions apply:

  1. If you reside in the European Economic Area (EEA) or the United Kingdom, the General Terms and Conditions of Use for European Users apply.
  2. For residents or businesses located in Australia, the General Terms and Conditions of Use for Australian Users are applicable.
  3. Canadian users are subject to the General Terms and Conditions of Use for Canada.
  4. For other jurisdictions, the General Terms and Conditions of Use for the United States govern your relationship with Discounted Safaris.

A) General Rules for Using the Platform

Discounted Safaris operates the Platform as a marketplace where Operators can promote and sell tourism services, such as multi-day tours, cruises, adventure experiences, exclusive trips, and other activities collectively referred to as «Adventure Tours.»

  • Access to and use of Discounted Safaris Services is strictly limited to individuals aged 18 or older. By using the Platform, you confirm that you are at least 18 years old.
  • If acting on behalf of a company or organization, you represent that you are legally authorized to accept these terms on behalf of the entity.
Permitted Use and Restrictions

The Services of Discounted Safaris are intended solely for personal, non-commercial use. It is strictly prohibited to:

  1. Sell or redistribute any information, products, or content obtained from the Platform.
  2. Use automated tools such as bots or scrapers to extract data or interact with the system.
  3. Attempt to bypass security measures or technical restrictions.
  4. Reverse-engineer or replicate any part of the Platform.
  5. Interfere with or damage the normal functioning of the Platform.

User-Provided Content

The Platform may allow you to upload, share, or post content such as images, text, videos, or graphics (collectively, the «Content»). By doing so:

  • You grant Discounted Safaris a non-exclusive, perpetual, royalty-free right to use such Content for promotional and communication purposes, both on the Platform and other channels.
  • You retain intellectual property rights over your Content but assume full responsibility for its publication and warrant that:
    • You own or have the necessary permissions to share the Content.
    • The Content does not violate any third-party rights, such as copyrights, trademarks, or privacy rights.

Prohibited Content includes:

  • Offensive, illegal, obscene material, or content promoting hate.
  • Unauthorized advertisements or promotional material.
  • Malware, viruses, or harmful files.

Discounted Safaris reserves the right to remove any content that violates these rules without prior notice.

Termination of Use

Both you and Discounted Safaris can terminate the contractual relationship at any time with immediate effect. To delete your account, send an email request to info@discountedsafaris.travel.

Note: Discounted Safaris is not obligated to remove previously published Content from the Platform.

B) Terms for Adventure Tours – The Role of Discounted Safaris

  • Operators are fully responsible for organizing and executing the Adventure Tours. Discounted Safaris acts solely as a commercial intermediary and is not involved in providing or organizing the services directly.
  • Discounted Safaris is not responsible for any travel-related services, including transportation or activities, nor does it act as an agent for either Travelers or Operators.

All bookings must be made directly with the corresponding Operator, and such bookings are subject to their terms and conditions.

Payments and Fees

  • Payment for safaris must be made directly to the organizing agency. Discounted Safaris assumes no responsibility for payments made to safari companies.

C) General Provisions

Liability

Discounted Safaris disclaims liability for minor negligence. This limitation does not apply in cases of:

  1. Fraud.
  2. Physical or personal injury.
  3. Breach of guarantees.
  4. Product liability claims.

Additionally, Discounted Safaris is not liable for:

  • The performance of the Safari Trip contract by the Operator.
  • Services excluded from the booked trip.
  • Additional services arranged by the Traveler independently after the trip begins.

Governing Law, Jurisdiction, and Dispute Resolution

  • These terms and conditions and the provision of Discounted Safaris’ services are governed by Spanish law, excluding its conflict of law provisions.
  • All disputes arising in connection with these terms or services shall be resolved exclusively by the competent courts in Barcelona, Spain.
